1. Scope of Application

These General Terms and Conditions (GTC) apply to all contracts for the rental of bicycles, accessories, bags, camping and outdoor equipment, as well as for the sale of products via the online shop batticuore.ch.

Hereinafter referred to as "Batticuore", "Lessor" or "Seller".

By making a booking, placing an order or using Batticuore's services, the customer accepts these GTC.

2. Rental

2.1 Definition

2.1.1 "Lessor" refers to Batticuore KLG as the provider of the rental items.

2.1.2 "Lessee" refers to the person renting a bicycle, accessories, or other rental items.

2.1.3 "Rental Item" refers to the rented bicycle including all rented components and accessories, in particular bags, luggage racks, locks, lights, chargers, batteries, tools, GPS holders, camping and outdoor equipment.

2.1.4 "Rental Period" refers to the agreed period between the handover and return of the rental item.

2.1.5 "Customer" refers to persons who purchase products in the online shop.

2.2. Subject of Contract for Rental

Batticuore rents bicycles, accessories and equipment for the agreed rental period. Unless otherwise agreed, the rental period is a minimum of 3 days and a maximum of 21 days.

The exact scope of the rental is determined by the booking, the booking confirmation and the rental item, including accessories, handed over at the time of delivery.

2.3. Rental Price and Deposit

2.3.1 The rental price is calculated per day and depends on the chosen rental item, the rental period and the chosen equipment.

2.3.2 The lessee is obliged to pay a deposit in the stated amount before the start of the rental. Unless otherwise stated, the deposit is CHF 250 per rental item.

2.3.3 The deposit serves to secure potential claims by Batticuore, particularly for damages, loss, theft, late return, missing accessories, cleaning costs or other expenses.

2.3.4 The deposit does not limit the liability of the lessee. If damages, loss or further costs exceed the deposit, the lessee remains obliged to pay the difference.

2.3.5 The deposit will be refunded after proper return of the rental item, provided there are no outstanding claims.

2.4. Booking and Payment

2.4.1 Booking takes place online via batticuore.ch or by individual arrangement.

2.4.2 The rental price and deposit are due before the start of the rental. Payment is made using the payment methods specified on the website.

2.4.3 The booking is only binding once Batticuore has confirmed the booking and payment has been successfully processed, unless another agreement has been made.

2.4.4 Batticuore may refuse a booking if there are doubts about the identity, solvency, suitability or reliability of the lessee.

2.5. Handover and Return

2.5.1 The rental item will be handed over at the agreed location and time.

2.5.2 The lessee is obliged to inspect the rental item upon handover and to report obvious defects, damages or missing parts immediately.

2.5.3 Batticuore hands over the rental item in a tested and roadworthy condition.

2.5.4 The rental item must be returned at the agreed time, at the agreed location, and in a relatively clean, complete and proper condition.

2.5.5 In case of late return, Batticuore may charge additional rental costs, compensation for inconvenience, consequential costs, and any losses due to subsequent bookings.

2.5.6 Heavily soiled rental items may be charged with an additional cleaning fee if the soiling exceeds normal use.

2.5.7 Batticuore is entitled to take photos or create protocols of the rental item during handover and return. These serve to document its condition.

2.6. Use of the Bicycle

2.6.1 The lessee undertakes to use the rental item carefully, properly and in accordance with applicable traffic regulations.

2.6.2 The lessee may not sublet, sell, pledge, transfer or otherwise surrender the rental item to third parties.

2.6.3 The lessee may only use the rental item for its intended purpose. In particular, improper use, willful overloading, jumps, downhill use, bike park use, races or competitions are not permitted, unless Batticuore has expressly agreed to this in writing.

2.6.4 The lessee is solely responsible for compliance with road traffic regulations, local rules, equipment requirements and any helmet obligations.

2.6.5 The lessee undertakes to regularly check the rental item for obvious defects during the rental period, especially tires, brakes, gears, wheels, screw connections and safety-relevant parts.

2.6.6 Should defects, malfunctions, accidents or damages occur during the rental period, the lessee is obliged to immediately interrupt use if continued travel could be unsafe, and to inform Batticuore without delay.

2.6.7 Unauthorized repairs or modifications to the rental item are only permitted with prior consent from Batticuore, unless they are necessary for immediate danger prevention or safe return.

2.7. Liability and Insurance

2.7.1 The lessee is liable for all damages to the rental item and the rented accessories that occur during the rental period and exceed normal wear and tear.

2.7.2 Normal wear and tear includes usual signs of use with proper handling. Not considered normal wear and tear are, in particular, damage from falls, frame damage, paint damage due to improper use, damage to forks, wheels, tires, gears, brakes, drivetrain, carbon parts, bags, locks, luggage racks, lights, chargers, batteries or other accessories.

2.7.3 The lessee is also liable for hidden damages that occurred during the rental period but are only discovered after return, provided they are attributable to use during the rental period.

2.7.4 Repairs will be carried out by Batticuore or by a specialist workshop designated by Batticuore. The actual repair costs, including spare parts, labor, inspection costs, shipping, transport and procurement costs, are decisive.

2.7.5 In the event of damage to carbon frames, carbon forks, carbon wheels, carbon handlebars, carbon seat posts or other carbon components, Batticuore may request a professional inspection, particularly after a fall or in case of suspected structural damage. The costs of this inspection shall be borne by the lessee, provided the damage or suspicion of damage arose during the rental period.

2.7.6 In the event of total loss or economic total loss, the lessee is liable up to the replacement value of the rental item, including accessories, less any residual value and any insurance benefits.

2.7.7 In the event of loss or damage to accessories, the lessee is liable for replacement or repair.

2.8 Theft, Loss, and Insurance Coverage

2.8.1 The lessee is liable during the rental period for loss, theft, robbery, embezzlement, and for the loss or theft of accessories.

2.8.2 In the event of theft, loss or robbery, the lessee is obliged to inform Batticuore immediately and to report it to the police within 24 hours. A copy of the police report must be sent to Batticuore without delay.

2.8.3 When not in use, the rental item must always be locked to a fixed, immovable object with the lock provided by Batticuore or an equivalent lock. Overnight, the rental item should, if possible, be stored in a closed room, garage, bike storage room, or a secure location.

2.8.4 The lessee is obliged to take reasonable measures against theft and loss. This includes, in particular, locking the rental item, carefully storing accessories, and avoiding unattended or unsecured parking.

2.8.5 The lessee is obliged to first claim against his own insurance, particularly personal liability, household contents, travel or theft insurance, in the event of a claim, provided such insurance exists and provides coverage.

2.8.6 Batticuore has insurance that may intervene in case of theft or certain damage events, particularly if the lessee does not have their own insurance or if their insurance does not provide coverage. However, the benefits of this insurance are only possible within the scope of the specific insurance conditions and require, in particular, timely notification, a police report, and compliance with due diligence obligations by the lessee.

2.8.7 Batticuore's insurance coverage does not automatically release the lessee from their liability. The lessee remains liable for deductibles, uncovered damages, insurance exclusions, damages caused by gross negligence or intent, and for damages for which the insurance conditions are not met.

2.8.8 If an insurance benefit is provided, Batticuore's claim against the lessee is reduced by the amount actually paid by the insurance.

2.8.9 In the event of gross negligence, intent, improper use, an unlocked rental item, missing police report, late notification or violation of other due diligence obligations, insurance coverage may be wholly or partially forfeited. In this case, the lessee is liable for the damage incurred.

2.9 Optional Damage Reduction

2.9.1 The lessee may, if offered in the booking process, opt for an optional damage reduction.

2.9.2 Upon concluding the damage reduction, the deductible for repairable damage to the rental item is reduced from CHF 1000 to CHF 200 per incident.

2.9.3 The damage reduction only applies to repairable damage to the rental item incurred during proper use.

2.9.4 The damage reduction does not cover, in particular, theft, loss, robbery, embezzlement, damage to third parties, personal injury, damage to items not rented, intent, gross negligence, improper use, unauthorized use, races or competitions without Batticuore's consent, transport and flight damage, damage due to transfer to third parties, and damage resulting from a breach of due diligence.

2.9.5 The damage reduction is not a general liability insurance for the lessee and does not replace personal liability insurance.

2.10 Damage to Third Parties and Personal Liability

2.10.1 The lessee is responsible for all damages caused to third parties during the rental period. This includes, in particular, personal injury, property damage, and financial losses.

2.10.2 The lessee undertakes to have sufficient personal liability insurance that covers damages in connection with the use of rented bicycles and equipment.

2.10.3 Batticuore expressly recommends that the lessee check their insurance coverage with their insurer before the start of the rental period.

2.10.4 Batticuore is not liable for damages caused by the lessee to third parties.

2.11 Liability of Batticuore

2.11.1 Batticuore hands over the rental item in a tested and roadworthy condition.

2.11.2 The use of the rental item is at your own risk.

2.11.3 Batticuore is not liable for accidents, injuries, property damage or other damages to the lessee or third parties, unless these were caused by intentional or grossly negligent conduct on the part of Batticuore or by a defect existing at the time of handover for which Batticuore is responsible.

2.11.4 Batticuore is not liable for damages caused by improper use, disregard of traffic rules, overestimation of one's own abilities, bad weather, poor road conditions, inadequate riding technique, lack of protective clothing, or use contrary to Batticuore's recommendations.

2.11.5 Batticuore is not liable for indirect damages, consequential damages, lost profits, loss of earnings, cancelled trips, replacement transport, hotel costs or other indirect damages, to the extent legally permissible.

2.11.6 Liability for auxiliary persons is excluded to the extent legally permissible.

2.12 Conduct in Case of Accident, Damage or Theft

2.12.1 In the event of an accident, damage, theft, loss or robbery, Batticuore must be informed immediately.

2.12.2 In the event of an accident involving a third party, personal injury, significant property damage, theft, loss or robbery, the lessee is obliged to call the police and have a report drawn up.

2.12.3 The lessee must provide Batticuore with all information and documents required for claims processing, in particular photos, accident details, police report, insurance details, contact details of involved persons and witnesses.

2.12.4 The lessee may not make any admission of guilt, settlement agreement or payment to third parties on behalf of Batticuore.

2.13 Cancellation of Rental

2.13.1 Cancellations are possible free of charge up to 14 days before the start of the rental.

2.13.2 For cancellations between 7 and 14 days before the start of the rental, 50% of the rental amount will be refunded.

2.13.3 In the event of later cancellation, non-collection or early return, there is no entitlement to a refund of the rental price.

2.13.4 In justified cases, Batticuore may offer a rebooking or credit note out of goodwill. There is no entitlement to this.

2.14 Obligations of Batticuore

2.14.1 Batticuore undertakes to check the rental item for obvious technical defects before each rental and to hand it over in a roadworthy condition.

2.14.2 Batticuore informs the lessee about known special features of the rental item, if these are relevant for its use.

3. Right of Return for Online Shop Purchases

3.1 Customers have the right to return goods within 14 days of delivery. The right of return is exercised by returning the goods; a reason is not required. The return must be sent to: Batticuore KLG Gutstrasse 127 8055 Zürich.

3.2 The exercise of the right of return leads to the conversion of the purchase contract into a reverse transaction relationship, according to which the services received under the purchase contract must be refunded. The costs for the return shipment are borne by the consumer.

3.3 Upon receipt of the goods, any purchase price already paid will be immediately refunded to the customer.

3.4 A deduction from the reimbursed purchase price or an invoice for possible damages, excessive wear and tear of the goods, or, if agreed, shipping costs for the goods, remains reserved. No deduction will be made if the loss in value is due to handling of the goods necessary to ascertain their nature, characteristics, and functionality. Batticuore.ch may refuse repayment until it has received the goods back or until the customer has provided proof that they have returned the goods, whichever is the earlier.

3.5 The right of return is excluded for none of the existing products.

4. Prices and Shipping Costs

4.1 The prices stated on the product page are exclusive of VAT (Batticuore is not VAT-registered) and are in Swiss Francs (CHF).
4.2 In addition to the stated prices, shipping costs may apply depending on the delivery address, quantity of goods and item. The exact shipping costs will be displayed to the customer during the ordering process. No further costs apply for deliveries within Switzerland.

5. Delivery Conditions

5.1 Delivery is only made to delivery addresses within Switzerland and the Principality of Liechtenstein.
5.2 The standard delivery time is 3-4 days, unless otherwise stated in the offer.
5.3 If not all ordered products are in stock, batticuore.ch is entitled to make partial deliveries. The customer will not incur any additional costs due to partial deliveries.
5.4 Should the delivery of the goods fail due to the fault of the customer despite three delivery attempts, the seller may withdraw from the contract. Any payments made will be refunded.

6. Payment Terms

6.1 Payment is made by credit card or other payment methods.
6.2 If the advance payment method is selected, the seller will provide their bank details in the order confirmation. The invoice amount must be transferred to the account of Batticuore.ch within 5 days. After that, the reserved products will be released again.
6.3 When paying by credit card, the customer's account will be debited upon order, unless otherwise agreed.
6.4 Offsetting with unrecognized or legally unconfirmed counterclaims by the customer is excluded.
6.5 The customer can only exercise a right of retention insofar as the claims are based on the same contractual relationship.

7. Retention of Title

The goods remain the property of Batticuore.ch until full payment. Before the transfer of ownership, pledging, collateral assignment, processing or modification is not permitted without the consent of Batticuore.ch.

8. Warranty

8.1 Batticuore.ch provides a warranty by rectifying defects. This is done, at its discretion, by subsequent performance, namely by eliminating a defect (rectification) or by delivering a defect-free item (replacement delivery).
8.2 If subsequent performance fails, the customer is entitled to withdraw from the contract. This does not apply to minor defects. A right of the customer to reduce the purchase price is excluded.

9. Liability

Batticuore.ch excludes liability for slightly negligent breaches of contract. The same applies to breaches of contract by auxiliary persons and substitutes.

10. Data Protection

Batticuore.ch undertakes to comply with data protection regulations when processing customer data. 11. Final Provisions

Should any provision of these general terms and conditions be invalid, the remainder of the contract shall remain valid. Instead of the invalid provision, the relevant legal provisions shall apply. These General Terms and Conditions come into force upon their publication on the landlord's website.
